San Francisco Real Estate News

Residents in Half Moon Bay are grappling with a significant coastal challenge as rising sea levels threaten their homes and public beaches. Last winter's storms caused considerable damage along California's coastline, including the collapse of bluffs near Casa Mira, a townhouse complex in Half Moon Bay. This event has sparked a broader debate about coastal erosion and property protection.

The Seawall Controversy

Homeowners at Casa Mira sought to build a concrete seawall for protection, a move initially supported by the Coastal Commission staff due to its safeguarding of the California Coastal Trail and a sewer line. However, in July 2019, the Coastal Commission rejected the seawall proposal, citing concerns about beach erosion and the precedent it would set. This decision led the homeowners to sue the Coastal Commission.

Legal Battle and Its Implications

In July 2022, the homeowners achieved a legal victory when a judge ruled that the Coastal Commission had violated the Coastal Act by not adequately balancing environmental protection with private property rights. The key issue centers on the definition of “existing structures” and whether the Coastal Act's permits for seawalls apply only to structures built before January 1, 1977, as argued by the Coastal Commission. The judge rejected this interpretation, and the Coastal Commission has since appealed.

Potential Impact on Coastal Development

The case's outcome could significantly influence coastal development across California. If the property owners prevail, it might lead to a broader allowance for seawalls and protective structures, challenging the Coastal Commission’s regulatory authority in the face of rising seas. This situation reflects the complex dilemma of addressing sea level rise and its potential impacts on existing coastal properties and public beaches.

“After meeting with a few real estate agents, we decided to choose Tim for our home purchase and we were not disappointed. Tim was always a text or a phone call away and provided us with everything we needed and more. He was with us every step of the way during the experience and we couldn’t have asked for a better agent. He is extremely knowledgable of the current market landscape and helped us negotiate for an offer below asking in the San Francisco market (amazing right?!). He is kind, friendly and will always have your best interest in mind when he is assisting in your home purchase. We wholeheartedly believe that if we had chosen another real estate agent to work with we might not have been able to purchase our home since Tim brings a bunch of intangible skills to the table that other agents simply do not possess. We would highly recommend Tim to our friends and family and we will not think twice about working with him again in the future.”

“My husband and I were the first time home buyers. We contacted Tim just couple of months after moving to San Francisco. Tim really helped us to learn about different neighbourhoods in SF. He showed us all the apartments that we wanted to visit even the ones that we could not afford. He is a good negotiator and we end of buying an apartment below the asked price.”
